IMPORTING NON ACCOMPANIED USED HOUSEHOLD GOODS & PERSONAL EFFECTS
Forbidden items: Fire arms, ammunition, alcohol*, tobacco*, drugs, medicament, explosive, flammable, corrosive or radioactive substances, food and liquids.
SPANIARDS: – Colored copy of D.N.I.– Declaration of value(relation of goods with a statistic value in Euros).- B/L consigned to your client.
– “Consular Discharge”: Original certificate from SPANISH CONSULATE in origin, in which the period of residence outside of the European Union must be indicated (start date and end

SECOND (TEMPORARY) RESIDENCE: Extra: Purchase or rental contract of a house minimum for next 2 years.
NOTE: Forms and required documentation must be sent to Orbit, via e-mail, by FAX or original (if required) before shipping to Spain.If Customs authorities consider it appropriate, original documentation will be required for a survey and copy of passport will have to be certified by consulate or a notary.
VEHICLES: – Purchase invoice of the vehicle.- Minimum 12 months in client’s possession.- Must be completely paid.
– Original documentation of the vehicle: certificate of title / ownership.
– Technical details sheet.
– Accomplishment of European greenhouse gas emissions standards: 1998/99 through agreements between the European Commission and the automotive industry.
DIPLOMATS:Goods imported with tax exemption by personnel with diplomatic status:Accredited personnel in Spain with diplomatic status (in Embassies, Consulates and International Organizations), are allowed to import with diplomatic status the goods needed for its own use and consumption during the period of its accreditation in Spain, although with a quarterly limit of 9.015,18 Euros.In any case, as far as alcoholic beverages and tobacco is concerned there are the following limitations, with quarterly nature:
a) Tobacco:
— Cigarettes 9.000 units.
— Cigars 65 units.
b) Alcohol and alcoholic beverages:
— Beverages derived: 90 liters.
— Sparkling wine: 30 liters.
Heads with Diplomatic Corps Mission are allowed to import with tax exemption the double of these quantities.
Required paperwork:
– Official statement letter from Embassy in Spain.
– Franchise concession from Spanish Ministry of Economy and Treasury addressed to Spanish Ministry
of Foreign Affairs and Cooperation.
– Copy of Passport and NIE (Número de Identificación de Extranjeros).
– Commitment Declaration and Dispatch Authorization.
– Statement from Spanish Ministry of Foreign Affairs, recognizing the new diplomat officially.
– * Commitment Declaration (“Declaración de compromiso”): Standard document provided by Customs (in Spanish only), in which client states that imported used household goods are for a personal use with no profit motive in mind.- ** Dispatch Authorisation (“Autorización de Despacho”):Standard document provided by Customs (in Spanish only), in which client authorities Customs dispatcher chosen by our agent to act on behalf of the importer as intermediary with local Customs Office.How to fill in the forms Client must fill in the gaps remarked in red as follows:
(1) Full name of the importer.
(2) Number of D.N.I / Passport.
(3) Full address of residence in Spain.
(4) Signature.
EXEMPTION OF RESPONSIBILITIES: As far as Orbit is taking efforts to actualize, translate and check at Customs regulations, Orbit will not accept any responsibility caused for possible errors or omissions. De conformidad con lo establecido en el Art. 199 del Reglamento CEE 2454/93, nos subrogamos en los compromisos que de dicha representación se deriven, respecto de la exactitud de las indicaciones, la autenticidad y veracidad de los documentos e informaciones, suministrados por nuestra empresa, al Agente de Aduanas y el cumplimiento de las obligaciones que de ello pudieran derivarse.
Asimismo, a los efectos de lo previsto en el R.D. 296/1998 de 27 de Febrero, y de la Ley 9/1998 de 21 de Abril, declaramos formalmente, que esta Empresa, en su condición de sujeto pasivo, tienen derecho a la deducción total del Impuesto de Valor Añadido que grava la importación.
La presente autorización se establece con carácter general, y surtirá sus efectos en tanto no sea revocada.

c) Han estado afectos a mi uso SEIS MESES antes del traslado de residencia.
ME COMPROMETO A:
a) LIQUIDAR LOS TRIBUTOS correspondientes en caso de que dichos bienes
fueran TRANSMITIDOS, CEDIDOS O ARRENDADOS durante el plazo de
DOCE MESES posteriores a la importación con franquicia de los bienes, de
acuerdo con el art. 7 del Reglamento (CEE) 918/83 del Consejo, de 28 de marzo
de 1983, relativo al establecimiento de un régimen comunitario de franquicias
aduaneras (DOCE L105 de 23 de abril de 1983) y con el art. 28 Dos. 6ª de la
Ley 37/1992 de 28 de diciembre, del Impuesto sobre el Valor Añadido (BOE 29
de diciembre de 1992), salvo causas justificadas a valorar por las autoridades
aduaneras.
b) Comunicar a las autoridades aduaneras cualquier cambio de domicilio de
conformidad con el art. 45.2 de la Ley 230/1963, de 28 de diciembre, General
Tributaria (BOE 313, de 31 de diciembre de 1963), según redacción dada al
mismo por la Ley 10/1985, de 26 de abril (BOE 101, de 27 de abril).
